Terms of Agreement

1. Product Licensing

All Divicio.us products, unless otherwise stated, are licensed under the GNU General Public License (http://www.gnu.org/licenses/gpl.html) version 2.0 or later.

2. Product Requirements

All Divicio.us products (child themes and plugins) are designed to work with Divi theme by Elegant Themes ONLY, you have to have the Divi theme installed and activated in order to be able to use our products.

3. Warranty

Products sold and distributed by Divicio.us are done so in the hope that they will be useful, but WITHOUT ANY WARRANTY; without even the implied warranty of MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE.

In as much as WordPress and Divi theme function correctly on a clean install, Divicio.us products are guaranteed to function on a clean install of the minimum, stable and required version of WordPress and Divi theme for Divicio.us products. Because the number and variety of WordPress products is vast and wide, we do not guarantee that our products will function with all third-party plugins, themes or browsers of any kind. We do not assume responsibility and will not be held responsible for any conflicts or compatibility issues that may occur due to third-party software. We assume no responsibility for any data loss as a result of installing or using Divicio.us products. Should conflicts occur with third-party software, we may provide support at our discretion.

4. Support

Divicio.us sells and distributes products “as is” and with no implied meaning that they will function exactly as you would like, or that they will be compatible with all third-party components and plugins. Before purchasing any of our products make sure you have read the product description and/or documentation, or contacted us for more information if necessary.

Support for products sold and distributed by Divicio.us is only available for those who have an active, paid license.

Support and updates for Divicio.us products are provided as long as these products are actively in development. Should any one of the following occur, Divicio.us will no longer be responsible for providing support for its products:

1. Divicio.us product is no longer actively developed as a viable product under Divicio.us.
2. Any or all of Divicio.us products or the parent company is purchased or bought out by another company.
3. WordPress is no longer actively developed.
4. Divi theme is no longer actively developed.

Whilst we attempt to provide the best support possible for our products, we do not guarantee that any particular support query can, or will be answered to the extent, or within a timeframe that the inquirer is completely satisfied.

5. Automatic Updates

Automatic updates are available to license holders who have an active and valid license key. Automatic updates are available for all Divicio.us plugins but not child themes. Automatic updates are available as long as the license key generated from the purchase is valid and active.

6. License Usage

Divicio.us grants each customer one or more non-transferable license(s) to use the software for internal use, and as defined by the terms set in the customer’s chosen license package.
Where the license package allows the software to be used on multiple sites the customer/license-holder may not on-sell the originally-purchased license key provided by Divicio.us, to other users of the license (such as clients) for commercial benefit.

Additionally, the customer may not sublicense, to any person or entity, any rights to distribute the software or license key. Divicio.us will only provide support services to the original customer/license-holder with a legitimate license key, and consider any other uses of this license key for support queries as fraudulent.

7. Product Delivery

After we have processed your payment successfully, you will receive an email with your order number and other purchase information, and another email with your automatically created account user name and password information. Your license key(if any) is available in your account area along with your product downloads. You can download the product by logging into the account created for you when purchasing the plugin and clicking on the appropriate link.

Should you not receive an email containing your information, you can contact us through https://divicio.us/support to request your purchase information.

Access to re-download purchased files will be granted so long as your license key is valid. If a license key expires, download access to the associated files will be discontinued until the license key is renewed.

8. Payment Methods

The only method of payment that we currently accept is PayPal. All products remain our property until paid for in full.

9. Ownership

All products are property of Divicio.us. Claiming any type of intellectual or exclusive ownership rights of our products is strictly prohibited.

Our products are provided “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential damages or losses that occur due to the use or inability to use our products.

10. Website & Products Content

All content found on Divicio.us site and throughout the products including images, documentation, support queries and any other information is property of Divicio.us and may not be redistributed without permission or consent.

11. Price Changes

Divicio.us reserves the right to modify, change, cancel or upgrade a product subscription and/or license key without prior notice or consent. Prices of all products are subject to change without prior notice or consent.

12. Refund Policy

We firmly believe in and stand behind our products, but we understand that it cannot work perfectly for everyone all of the time. If you are unhappy with your purchase, or you have an issue that we are unable to resolve that makes the system unusable, we will be happy to consider offering a refund. Refunds will be offered at our sole discretion and must meet all of the following conditions listed below:

1. You are within the first 30 days of the purchase of the product. No refunds will be granted after the first 30 days of the original purchase whatsoever.
2. Your issue(s) comes from not being able to install the product properly or get the product to perform its basic functions.
3. You have attempted to resolve your issue(s) with our support team.
4. Issues caused by 3rd party plugins, themes or other software will not provide grounds for a refund.
5. No refunds will be granted for the reason that some (or all) of the features of the product are getting included into the Divi theme core features set as the theme is evolving.
6. The fact that the product is missing a specific feature does not provide grounds for a refund. All the information about the product is provided on the product's page and you are welcome to contact us via the contact form to obtain any additional information before making the purchase.

By purchasing product(s) from Divicio.us site, you agree to this refund policy and relinquish any rights to subject it to any questions, judgment or legal actions.

Please be aware that you will need an amount of experience in Divi Theme and WordPress to take advantage of our themes and plugins. Make your decision to purchase based upon your skill level to see if our products fit your needs. Due to the nature of Digital Downloads we do not offer refunds under any circumstances if the product is not found to be faulty.

13. Email

Divicio.us may occasionally send you emails related to the purchase of product(s) from our company. We may also send you occasional email newsletters relating to Divicio.us product updates, promotions, and the like. We will never sell or release your email to any third party vendors. You may opt out of these emails at any time without penalty.

14. Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavors to comply with the terms and conditions of any Agreement contained herein.

15. License Agreement

By purchasing our product(s), you indicate and consent that you have read and agree to the Terms & Conditions listed and detailed on this page. We reserve the right to change or modify the current Terms and Conditions without prior notice or consent and your continued use of the site will signify your acceptance of any adjustment to these terms. 

16. Severability

If any part of this agreement is declared unenforceable or invalid, all remaining clauses in this agreement shall remain binding on the customer.
